Case Study

Richard was married with two grown children. Having experienced marital conflict in the past, he worried that should he die, his wife would re-marry and the new spouse would convince her to change her will leaving the new spouse as the new beneficiary.


We helped him set up marital bypass trusts where he could control his money after his death. These trusts would allow his wife to live off the income that the assets earned for as long as she lived; but, it also insured the kids (and not the new spouse) would inherit the assets in the trust.


In another case, our client Samuel unexpectedly passed away
leaving $22,000,000 to his wife. To preserve his $12,060,000 estate exemption we advised her to file a Form 706 for him now under the portability law. This strategy allows all $22,000,000 to pass to the kids tax-free. If she moved all the assets under her name instead without filing the 706, she would have to file the 706 at her death and pay $3,479,000 in tax.
